FEDERAL AND STATE CRIMINAL DEFENSE

We represent individuals and corporations from the investigatory stage to arrest/bail, indictment, trial, sentencing, and appeal.  We represent individuals charged with the following types of crimes under Federal and New York State law:

  1. White Collar Crimes:

    • Federal white collar crimes encompass various financial and business-related offenses, including fraud, embezzlement, and insider trading.

      • Relevant Statutes: 18 U.S.C. Chapter 63 (Mail Fraud and Other Fraud Offenses), Chapter 96 (Racketeer Influenced and Corrupt Organizations - RICO), Chapter 63 (Securities Fraud), and more.

    • New York State white collar offenses include fraud, embezzlement, identity theft, and financial crimes.

  2. Drug Crimes:

    • Federal drug offenses involve violations of controlled substances laws, including trafficking and distribution.

      • Relevant Statutes: 21 U.S.C. Chapter 13 (Drug Abuse Prevention and Control).

    • New York State drug offenses include possession, sale, or trafficking of controlled substances.

      • Relevant Statutes: N.Y. Penal Law Article 220 (Controlled Substances Offenses).

  3. Violent Crimes:

    • Federal violent crimes include offenses such as bank robbery, kidnapping, and terrorism.

      • Relevant Statutes: 18 U.S.C. Chapter 113B (Terrorism), Chapter 37 (Espionage and Censorship), Chapter 44 (Firearms), and more.

    • New York State violent offenses include assault, robbery, murder, and manslaughter.

      • Relevant Statutes: N.Y. Penal Law Article 120 (Assault), Article 160 (Robbery), Article 125 (Homicide).

  4. Cyber/Computer Crimes:

    • Federal computer-related offenses include hacking, identity theft, computer fraud and abuse, crimes related to the improper use of access devices, DDOS attacks, credit card fraud, and others.

      • Relevant Statutes: 18 U.S.C. Chapter 63 (Computer Crime), Chapter 121 (Stored Wire and Electronic Communications and Transactional Records Access), and more.

    • New York State computer-related offenses include hacking and online fraud.

      • Relevant Statutes: N.Y. Penal Law Article 156 (Computer Offenses).

  5. Firearms and Weapons Offenses:

    • Federal weapons offenses include illegal possession of a firearm, illegal sale or transfer of a firearm, firearms trafficking, possession of a firearm in furtherance of a crime, and illegal possession of a destructive device, among others.

      • Relevant Statutes: 18 U.S.C. Chapter 40 (Explosive Material) and 44 (Firearms).

    • New York State weapons offenses include criminal possession of a firearm, criminal sale of a firearm, criminal use of a firearm, possession of a defaced firearm, and criminal possession of a weapon, among others. New York City also includes administrative codes that prohibit the possession and use of firearms and firearm parts.

      • Relevant Statutes: N.Y. Penal Law Article 265 (Firearms and Other Dangerous Weapons)

  6. Property Crimes:

    • New York State property offenses include burglary, larceny, and criminal mischief.

      • Relevant Statutes: N.Y. Penal Law Article 140 (Burglary), Article 155 (Larceny), Article 145 (Criminal Mischief).

Post Conviction and Appellate Practice:  We represent individuals on appeal and other post-conviction proceedings including 2255 petitions (habeas), 440 motions, 330.30 motions.  We have also been successful obtaining bail pending appeal for numerous clients.

Business Disputes and Commercial Claims

Commercial claims and business disputes refer to legal disputes that arise in the context of business transactions, contracts, and commercial relationships. These claims can involve breach of contract, business torts, intellectual property disputes, and more. Our goal is to achieve favorable outcomes efficiently and cost-effectively. We begin by thoroughly analyzing the details of your case and crafting a tailored strategy designed to protect your interests. We explore negotiation, mediation, and alternative dispute resolution methods when appropriate, but we are always prepared to litigate aggressively when necessary. We represent business and individuals in the following types of commercial claims:

  • Breach of Contract: Allegations that a party failed to fulfill its contractual obligations. These may be brought under common law, the Uniform Commercial Code (N.Y. UCC.), and/or New York General Obligations Law, Article 2 (N.Y. Gen. Oblig. Law, Art. 2)

  • Business Torts: Claims involving wrongful actions in a business context, such as fraud, misrepresentation, breach of fiduciary duty, interference with business relationships, false advertising, and consumer fraud.

  • Intellectual Property Disputes: Matters related to trademark infringement (Lanham Act - 15 U.S.C. § 1051 et seq.), copyright infringement (U.S. Copyright Act -17 U.S.C. § 101 et seq.), and theft of trade secrets.

  • Business Partner Disputes: Conflicts among owners or partners within a business entity, generally involving allegations that corporate officers, owners, or partners have breached their fiduciary duties.

Civil Litigation

We bring a wealth of experience and a strong track record to the table when it comes to representing clients in intentional tort claims such as defamation, assault, battery, and intentional infliction of emotional distress, civil rights and constitutional claims, as well as employee-side employment discrimination, harassment, and retaliation claims:

  • Torts:

    • Defamation: Including claims for libel, slander, false light, and invasion of privacy.

    • Intentional Torts: Including assault, battery, intentional infliction of emotional distress, false imprisonment, and more.

    • Property Torts: Trespass, nuisance, conversion, and others.

  • Constitutional and Civil Rights Actions: Protecting and enforcing clients' civil rights in matters involving discrimination, constitutional violations, and government accountability.

  • Employment Disputes: Assisting clients in cases of workplace discrimination, harassment, wrongful termination, wage and hour violations, and retaliation claims.

  • New York Child Victims Act: We also have experience representing sexual abuse survivors throughout New York. On February 14, 2019, New York Governor Andrew Cuomo signed into law the New York Child Victims Act, Senate Bill No. S. 2440/Assembly Bill No. A. 2683. This law allows victims of child sexual abuse to pursue civil lawsuits against their abusers and the institutions that permitted such abuse, regardless of the statute of limitations. In anticipation of the Child Victims Act becoming operational on August 14, 2019, we are working with attorneys who have decades of experience representing survivors of child sexual abuse against religious institutions, public and private schools, and youth organizations.
